General Terms and Conditions of Sale (GTCS)

These general terms and conditions of sale govern the contractual relationships between the company Grafixfun, operated by MARIANI André Dominique, whose registered office is located at Chemin de Mascardaccia 2, 20129 BASTELICACCIA, France, registered with the Ajaccio Trade and Companies Register under number 894 096 221 (hereinafter referred to as "the Seller" or "FELPATEE") and any individual consumer (hereinafter referred to as "the Customer") wishing to make a purchase on the FELPATEE online store (www.felpatee.com).

Article 1 - Purpose

The purpose of these GTCS is to define the conditions under which the sales of products offered by FELPATEE on its online store are conducted for Customers. They govern all the necessary stepsfor placing the order and ensure the follow-up of this order between the contracting parties.

Article 2 - Products

The products offered for sale by FELPATEE are sweatshirts and t-shirts printed on demand with animal designs. The essential characteristics of the products are presented on the online store. The Customer is invited to familiarize themselves with this information before placing an order. The photographs and descriptions of the products are not contractual and cannot engage the responsibility of FELPATEE.

Article 3 - Prices

The prices of the products are indicated in euros (€). In accordance with article 293 B of the General Tax Code (CGI), VAT is not applicable. The prices are therefore understood to be excluding taxes (HT), with no VAT amount being collected by FELPATEE.

Shipping costs are indicated separately before the Customer validates the order. FELPATEE reserves the right to modify its prices at any time, but the products will be billed based on the rates in effect at the time of the order registration, subject to availability.

Article 4 - Order

To place an order, the Customer must follow the following steps on the online store:

  1. Select the products and add them to the cart.
  2. Check the contents of the cart and, if necessary, modify it.
  3. Identify the Customer (or create an account).
  4. Complete the secure order form (shipping and billing information).
  5. Choose the payment method.
  6. Accept these GTCS.
  7. Finalize the order and payment.

The confirmation of the order by the Customer constitutes full and unconditional acceptance of these GTCS, the prices, and the characteristics of the ordered products. FELPATEE will send the Customer an order confirmation email summarizing the order information.

Article 5 - Payment

The price is payable in full at the time of order placement. The accepted payment methods are as follows:

  • Bank cards (Visa, Mastercard, etc.) via a secure payment platform.
  • PayPal via a secure payment platform.

The Customer guarantees to FELPATEE that they have the necessary authorizations to use the chosen payment method. FELPATEE reserves the right to suspend or cancel any order in case of refusal of payment authorization from the financial institutions.

Article 6 - Delivery

The delivery methods are detailed in the Shipping Policy available on the online store. Delivery is made to the address indicated by the Customer at the time of the order. Delivery times are indicative and do not constitute a contractual commitment.

Article 7 - Right of Withdrawal and Exceptions

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal of 14 days cannot be exercised for contracts for the supply of goods made according to the specifications of the consumer or clearly personalized.

Since the products offered by FELPATEE (t-shirts, sweatshirts, mugs) are made on demand and personalized for each order, they are considered personalized goods and are therefore not subject to the legal right of withdrawal for a simple change of mind or a size/color error on the part of the customer.

As a result, returns are accepted only in cases of defective, damaged, incorrect, poorly printed, or non-compliant products.

In these specific situations, and in accordance with our Return and Refund Policy available on the Site, the Customer has a period of 14 days from the receipt of the products to report the issue. To exercise this right, the Customer must notify FELPATEE of their decision by means of an unequivocal statement (by email to [contact@felpatee.com]), providing the necessary evidence (photos, order number).

The Customer must return the products in their original and complete condition (packaging, accessories, instructions…) no later than 14 days after communicating their decision and obtaining our validation. Return shipping costs are the responsibility of the Customer, unless the non-compliance is proven and validated by FELPATEE.

The refund for the price of returned products (in eligible cases) will be made within 14 days from the receipt of the returned products or proof of their shipment by the Customer. The refund will be made using the same payment method that the Customer used when placing the order, unless expressly agreed otherwise.

Article 8 - Legal Warranty of Conformity

In accordance with articles L. 217-4 and following of the Consumer Code, the products sold by FELPATEE benefit from a legal warranty of conformity for a duration of two years from the delivery of the goods.

In case of non-conformity, the Customer may choose between repair and replacement of the goods. If repair or replacement is impossible or incurs disproportionate costs, the Customer may obtain an appropriate reduction in price or the termination of the contract.

Article 9 - Complaints and After-Sales Service (AS)

For any questions, complaints, or requests regarding an order, a product, or After-Sales Service, the Customer can contact FELPATEE by email at the following address: contact@felpatee.com. FELPATEE will strive to respond as quickly as possible.

Article 10 - Intellectual Property

All elements of the site www.felpatee.com, whether visual or auditory, including texts, graphics, logos, images, photographs, are and remain the intellectual and exclusive property of FELPATEE. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, without the prior written authorization of FELPATEE, is strictly prohibited and constitutes a counterfeiting punishable by the applicable laws.

Article 11 - Liability

The liability of FELPATEE cannot be engaged in the event of non-compliance with the legislation of the country where the products are delivered, which it is the Customer's responsibility to verify. FELPATEE shall not be liable for indirect damages, loss of profits, or loss of opportunity resulting from the use of the online store or the purchase of products.

Article 12 - Applicable Law and Disputes

These GTCS are subject to French law. In the event of a dispute, the Customer will first contact FELPATEE to seek an amicable solution. In the absence of an amicable agreement, the French courts shall have sole jurisdiction to settle any dispute relating to the interpretation or execution of these GTCS, in accordance with the applicable rules of jurisdiction.

Article 13 - Miscellaneous Provisions

If one or more provisions of these GTCS are declared null or unenforceable under a law, regulation, or as a result of a final court decision, the other provisions shall retain their full force and effect. The fact that FELPATEE does not invoke at any given moment any of the provisions of these GTCS shall not be interpreted as a waiver to subsequently invoke the same provision. These GTCS are written in French. In case of translation, only the French version shall be authoritative.
